These Terms of Service ("Terms") govern your access to and use of GMPS("App"), the GMPS website (the "Site"), and related services (collectively, the "Services") operated by PIKA GROUP LTD ("Company," "we," "us," or "our").
By creating an account, downloading the App, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old (or the legal age for betting/gambling where you live, whichever is higher).
You must have the legal capacity to enter into a binding contract.
You may use the Services only where lawful. The Services are not available in jurisdictions where peer-to-peer wagering is prohibited.
We may request proof of age or identity at any time. Failure to provide such proof may result in suspension or termination of your account.
2. Accounts and Security
Registration: You must provide accurate, current, and complete information when creating an account.
One Account: You may only maintain one account. Multiple accounts may be closed without notice.
Security: You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately of any unauthorized use.
Account Activity: You are responsible for all activity that occurs under your account.
3. Peer-to-Peer Bets
The Services facilitate peer-to-peer wagering between users. The Company does not participate in bets, set odds, or guarantee outcomes.
Creating Bets: You may create or accept bet proposals with other users. All bets are binding once accepted by both parties.
Bet Terms: You are responsible for understanding the terms of each bet, including the event, stake, odds, and settlement conditions.
No Cancellation: Once a bet is accepted and confirmed, it cannot be canceled unless both parties agree or the event is canceled/postponed.
Results: Bet results are determined based on official sources or data providers. The Company's determination of results is final.
4. Wallets, Funding, and Withdrawals
Wallet: Your account includes a digital wallet to hold funds for betting. The wallet is not a bank account and does not earn interest.
Deposits: You may fund your wallet using approved payment methods. All deposits are subject to verification and may be delayed or rejected.
Withdrawals: You may withdraw funds from your wallet at any time, subject to verification, minimum withdrawal amounts, and processing times.
Fees: Certain transactions may be subject to fees (see Section 7).
Currency: All transactions are conducted in the currency specified in your account settings.
We reserve the right to refuse, delay, or reverse any transaction if we suspect fraud, money laundering, or violation of these Terms.
5. Verification (KYC/AML)
To comply with legal and regulatory requirements, we may require you to verify your identity ("Know Your Customer" or KYC) and provide documentation, including:
Government-issued photo ID (passport, driver's license, etc.)
Proof of address (utility bill, bank statement, etc.)
Payment method verification
Source of funds documentation
Failure to complete verification may result in restrictions on your account, including the inability to deposit, withdraw, or place bets.
We comply with anti-money laundering (AML) laws and may report suspicious activity to relevant authorities.
6. Settlement, Results, and Disputes
Settlement: Bets are settled based on official results from trusted data providers or sources. Settlement is typically automatic but may be delayed in certain circumstances.
Disputes: If you believe a bet was settled incorrectly, you may submit a dispute within 7 days of settlement. We will review and make a final determination.
Voided Bets: Bets may be voided if an event is canceled, postponed, or if there is an error in the bet terms. Voided bets result in stakes being returned.
Final Decision: The Company's decision on all bet settlements and disputes is final and binding.
7. Fees
The Company may charge fees for certain services, including:
Transaction Fees: Fees for deposits, withdrawals, or currency conversions.
Service Fees: A percentage or flat fee on winning bets or other transactions.
Inactivity Fees: Fees for prolonged account inactivity (after notice).
All applicable fees will be disclosed before you complete a transaction. Fees are subject to change with notice.
8. Responsible Gambling
We are committed to promoting responsible gambling. You acknowledge that:
Gambling can be addictive and should be done responsibly.
You should only bet what you can afford to lose.
You are responsible for managing your gambling activity.
We provide tools to help you manage your gambling, including:
Deposit Limits: Set daily, weekly, or monthly deposit limits.
Loss Limits: Set limits on losses over a specified period.
Time Limits: Set limits on time spent using the Services.
Self-Exclusion: Temporarily or permanently exclude yourself from the Services.
Reality Checks: Receive notifications about time spent and money wagered.
If you believe you have a gambling problem, please seek help from organizations such as:
Use the Services for any illegal purpose or in violation of any laws.
Create multiple accounts or use another person's account.
Engage in fraud, money laundering, or other financial crimes.
Manipulate or attempt to manipulate bet outcomes, odds, or results.
Use bots, scripts, or automated tools to access or use the Services.
Collude with other users to gain an unfair advantage.
Reverse engineer, decompile, or disassemble any part of the Services.
Interfere with or disrupt the Services or servers.
Harass, abuse, or harm other users.
Post or transmit any unlawful, offensive, or inappropriate content.
Violation of these prohibitions may result in immediate termination of your account and forfeiture of funds.
10. Privacy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
11. Termination
By You: You may close your account at any time by contacting us. You must withdraw all funds before closing your account.
By Us: We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, or legal requirements.
Effect of Termination: Upon termination, you must cease all use of the Services. Any outstanding bets will be settled according to their terms. Funds in your wallet may be returned to you, subject to verification and applicable fees.
We reserve the right to retain certain information as required by law or for legitimate business purposes.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that:
The Services will be uninterrupted, secure, or error-free.
Results, odds, or data will be accurate or reliable.
Any errors or defects will be corrected.
The Services will meet your requirements or expectations.
You use the Services at your own risk. We are not responsible for any losses resulting from your use of the Services.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
14. Governing Law and Disputes
These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.
Any disputes arising out of or related to these Terms or the Services shall be resolved through:
Informal Resolution: We encourage you to contact us first to resolve any disputes informally.
Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the United Kingdom Arbitration Act, unless prohibited by law.
Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions or class arbitrations.
You may opt out of arbitration by notifying us in writing within 30 days of accepting these Terms.
15. Changes
We may update these Terms from time to time. If we make material changes, we will notify you by:
Posting the updated Terms on the Site or App.
Sending an email notification to your registered email address.
Providing an in-app notification.
Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services and close your account.
